Terms of Service

These Terms of Service (“Terms”) apply to international customers who use the bird DNA sexing service provided by forbird (“we,” “us,” or “our”).
By submitting an order, you agree to be bound by these Terms, our Privacy Policy, and our Sample Submission Guidelines.

1. Service Overview

We provide DNA-based sex identification for birds using feather or dried blood samples submitted by customers. Test results are delivered by email in PDF format.

Important: This service is for sex identification only and is not a veterinary diagnostic service.

2. Ordering and Payment

Orders must be submitted through our online application form.

Payment must be completed in advance via a Stripe credit/debit card payment link. Available payment methods may vary depending on your country or region.

Fees are non-refundable, including (but not limited to) cases where a sample cannot be tested due to damage, contamination, degradation, incorrect submission, loss during shipment, or disposal/retention by customs authorities.

3. Shipping Samples

Customers are responsible for preparing, packaging, and shipping their samples to our designated address.

  • We do not provide prepaid shipping labels.
  • Shipping fees, customs duties, taxes, and other related costs must be paid by the customer.
  • We are not responsible for samples that are delayed, lost, damaged, returned, destroyed, or disposed of by postal services, couriers, or customs authorities.
  • International shipments may be subject to your local import regulations. You are responsible for complying with your country’s laws and regulations.

4. Acceptable Sample Types

We accept the following sample types:

  • Feathers (preferred):
    Both naturally shed feathers and gently collected feathers with intact roots are acceptable.
  • Dried blood samples on paper

We do not accept fresh liquid blood, tissue, feces, or other sample types.

5. Testing and Results

Test results are typically delivered by email within the turnaround time stated on our website. Delivery times may vary depending on sample quality, laboratory workload, and shipping/customs delays.

If a valid result cannot be obtained due to poor sample condition, we will request a re-test. The re-test itself is free of charge; however, shipping costs for sending a new sample are the customer’s responsibility.

Note: In some cases, we may ask you to submit a new sample if the first sample does not contain sufficient DNA for analysis.

6. No Diagnostic or Medical Claims

Our DNA sexing service is not a veterinary diagnostic service. We do not diagnose diseases, evaluate health conditions, or provide medical advice.

7. Use of Samples for Research and Development

Submitted samples may be stored and used for quality control, method improvement, and other internal purposes. Samples or extracted DNA may also be used for research and development activities, including potential academic publications or patent applications.

  • We do not provide DNA sequence data or raw genomic data to customers.
  • Samples or data may be shared with external research institutions if necessary for scientific or operational purposes. Personal identifying information will not be shared in research outputs unless explicit consent is obtained.

8. Personal Data

Your personal information is collected and processed in accordance with our Privacy Policy. By placing an order, you consent to the handling of your information and sample-related data as described therein.

9. Customer Responsibilities

Customers must ensure that:

  • The sample truly belongs to the bird specified in the order.
  • The sample is properly dried, clean, and packaged.
  • Shipping instructions and local import rules are followed.
  • Accurate contact information is provided for receiving test results.

We are not responsible for misidentification resulting from mislabeled, contaminated, or incorrect samples.

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for delays, losses, or damages arising from shipping, customs inspections, or communication failures.
  • Our liability is strictly limited to the amount paid for the applicable test fee.
  • We are not responsible for consequential, indirect, incidental, or special damages.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Japan.

12. Changes to the Terms

We may update these Terms at any time. The latest version will always be published on our website.
